Introduction
These Terms of Service (“Terms”) form the agreement between Magik Hosting (“we”, “us”, “our”) and you, the customer (“client”, “user”).
By creating an account, subscribing to our hosting, domain, or email services, or using our website, you agree to these Terms.
Our mission is simple: to provide secure, reliable hosting solutions with personal support and honest communication.
Scope of Services
Magik Hosting provides:
- Website hosting using Unix-based cPanel environments
- WordPress-optimised hosting
- Business email hosting
- Domain registration and renewal services
- Technical support, migration, and configuration assistance
We may update or modify our services at any time. Notice will be provided where changes significantly affect customers.
Account Responsibilities
- You are responsible for maintaining secure login credentials and account passwords.
- You must provide accurate and current contact, billing, and payment details.
- You agree to use our services in compliance with our Acceptable Use Policy.
- You must promptly notify us of any unauthorised access or suspected security breach.
Service Availability
We target 99.9% uptime for hosting services, excluding:
- Scheduled maintenance or upgrades (with prior notice)
- Events outside our control (e.g. network or third-party disruptions, force majeure)
We make all reasonable efforts to minimise downtime and restore services quickly.
Data & Backups
Magik Hosting performs daily automated backups with a 30-day retention period.
While we take care to safeguard data, customers are responsible for maintaining their own additional backups as an extra precaution.
Security
We use SSL encryption, firewall protection, malware scanning, and threat detection through trusted cloud providers.
You agree not to compromise, bypass, or interfere with server security or the data of other customers.
Payments & Billing
- Hosting: billed monthly after any free trial period.
- Email Hosting: billed monthly or annually.
- Domain Registration: prepaid for the full term.
Invoices are sent via email. Services may be suspended if payment is not received by the due date.
Free Trial
New hosting customers receive 6 months free as advertised.
No fees apply during this period. After 6 months, standard monthly billing will begin unless the service is cancelled before the trial ends.
Cancellations & Termination
- You may cancel any service at any time via written notice (email accepted).
- We reserve the right to suspend or terminate accounts for non-payment, policy violations, or security risks.
- Upon termination, data may be deleted after 14 days and cannot be recovered.
Liability Limitation
To the maximum extent permitted by law, Magik Hosting is not liable for:
- Indirect, incidental, or consequential damages
- Data loss or business interruption due to third-party failures
Our total aggregate liability is limited to the amount paid by you for the affected service in the 12 months preceding the claim.
Changes to Terms
We may update these Terms periodically. The latest version will always be available on our website.
Continued use of our services constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of Queensland, Australia.
Any disputes will be handled in the jurisdiction of Queensland courts.
